ARA Filed Comments to FTC on Non-Compete Clause Rule

ARA filed comments to the Federal Trade Commission (FTC) opposing a blanket ban on non-compete clauses because the FTC lacks the legal authority to institute such a significant wide-sweeping rule.
The non-compete ban would significantly harm ag and rural economies already facing numerous systemic challenges, according to ARA's comments.
If the FTC persists in issuing a final rule, it should take a more measured, incremental approach by providing guidelines to states in their regulation of non-compete clauses, and it should consider carve-outs for agricultural retailers who face exogenous circumstances.
