Ag retailers work diligently to keep their employees, farmer customers, and communities safe by complying with strict environmental, health, safety and security regulations when storing, handling or transporting fertilizer products.

ARA Position

  • Oppose any legislative or regulatory proposal that includes an inherently safer technology (IST) requirement, citizen enforcement provisions, or weakening of federal preemption
  • Maintain active participation on the Chemical Sector Coordinating Council
  • Work with DHS, Congress, the National Fire Protection Association (NFPA) and industry on a workable and practical ammonium nitrate (AN) registration regulation and engage on any other IED precursor regulatory discussion, while working to establish a reasonable list of Chemicals of Interest (COI)
  • Work with DHS, FBI, and other organizations to highlight security and cybersecurity concerns related to the sale of crop inputs in the e-commerce marketplace
  • Engage in the Chemical Facility Anti-Terrorism Standards (CFATS) rulemaking and reauthorization processes
  • Work with appropriate government agencies to promote education and training for federal regulations related to the storage and security of anhydrous ammonia
  • Partner with the FBI and DHS towards the prevention of illegal misuse of fertilizer products in the U.S. and abroad while balancing the access of products to growers in meeting global food needs
  • Continue educational campaigns and guidance directed at promoting the safe handling, storage and distribution of fertilizer products to retailers through ResponsibleAg.
