ARA Supports Bicameral CRA Resolution of Disapproval to Overturn NEPA Phase II Final Rule

Senator Joe Manchin (I-WV), Chairman of the U.S. Senate Energy and Natural Resources Committee, joined Senator Dan Sullivan (R-AK) and Congressman Garret Graves (R-LA-06) to introduce a bipartisan, bicameral Congressional Review Act (CRA) resolution of disapproval to overturn the National Environmental Policy Act (NEPA) Phase II Final Rule.
ARA along with a broad coalition of industry groups has sent a letter of support for this bipartisan Congressional effort to overturn this regulation and enact comprehensive permitting reform that promotes efficiency, predictability, and transparency.
The new Biden Administration NEPA requirements adds complicated and subjective requirements to the permitting process that will make it less predictable for project sponsors.
In addition, the rule will overturn decades of NEPA permitting practice and is not consistent with U.S. Supreme Court precedent interpreting the statue.
