ARA Co-signed Coalition Comments to EPA on Maui Guidance

ARA co-signed coalition comments related to the U.S. Environmental Protection Agency (EPA) guidance following the U.S. Supreme Court's ruling on County of Maui v. Hawaii Wildlife Fund.
The coalition generally supports the EPA guidance and agrees that the majority of discharges through groundwater are not the functional equivalent of a direct discharge, and thus remain outside the scope of NPDES permitting.
The Maui case did not change the requirement that there be a “point source” discharge before regulatory jurisdiction can be established under the Clean Water Act.
